Terms of use

Welcome to the SoulFire DMC website. SoulFire DMC (“SoulFire,” “we,” “us,” or “our”) is a social motorcycle club based in Oakland, California. These Terms of Use govern your access to and use of the SoulFire website. By accessing or using this website, you agree to these terms. If you do not agree with them, please do not use the website.

1. Relationship to Other Policies and Agreements

These Terms of Use govern access to and use of the SoulFire website. Our Privacy and Website Policy explains how information submitted through or collected by the website may be handled. Participation in a SoulFire ride or activity may be governed by a separately presented Rider Disclaimer and Liability Waiver, along with any applicable ride rules or safety requirements. These Terms of Use do not replace, expand, or constitute acceptance of a separate rider waiver. Likewise, a rider waiver does not govern the collection and handling of personal information through the website.

2. Purpose of the Website

The SoulFire website provides general information about:
  • SoulFire DMC;
  • our history, purpose, and activities;
  • social motorcycle rides and public events;
  • how to contact us;
  • links to our Meetup and social-media pages; and
  • public calendar information.
The website is provided for informational and community purposes. SoulFire does not sell merchandise or process ride registrations or payments through this website.

3. No Membership, Registration, or Participation Guarantee

Using this website, submitting a contact form, following SoulFire on social media, responding to a Meetup listing, adding an event to a calendar, or subscribing to our public calendar does not:
  • make you a member of SoulFire;
  • guarantee that you may participate in a ride or event;
  • reserve or confirm a place at a ride or event;
  • confirm that an event will occur as originally listed;
  • demonstrate that you satisfy applicable participation requirements;
  • constitute acceptance of a separate Rider Disclaimer and Liability Waiver;
  • create an employment, agency, partnership, or other legal relationship with SoulFire; or
  • guarantee acceptance of a membership or prospect application.
Membership and participation decisions are handled separately under SoulFire’s applicable club procedures, ride requirements, and any event-specific agreements.

4. Meetup, Ride Listings, and Event Information

SoulFire uses Meetup to publish ride information and to allow interested individuals to respond to ride listings. A Meetup response is an expression of interest only unless the applicable listing expressly states otherwise. We make reasonable efforts to provide accurate ride and event information. However, ride details may change at any time because of:
  • weather;
  • road or traffic conditions;
  • safety concerns;
  • mechanical problems;
  • organizer availability;
  • venue availability;
  • public emergencies; or
  • other circumstances beyond our control.
SoulFire may change, postpone, relocate, or cancel a ride or event without prior notice. Before traveling to an event, you should check the applicable Meetup listing for the latest available information. Information appearing on the website, calendar, or Meetup page does not guarantee that a ride, event, route, meeting location, road, or destination will be available, open, suitable, or safe.

5. Nature of SoulFire Rides

SoulFire rides are informal, community-oriented social motorcycle gatherings. They are not professional motorcycle tours, training courses, races, marshaled events, or commercially guided excursions. Unless specifically stated otherwise for a particular event, SoulFire does not provide mechanical support, sweep vehicles, medical services, or traffic control. SoulFire follows a “Ride Your Own Ride” philosophy. Each participant operates their own motorcycle independently and is responsible for riding within their own experience, skill, comfort, and physical limits. No participant should ride faster or more aggressively merely to keep up with another rider or the group.

6. Motorcycle Safety and Rider Responsibility

Motorcycling involves inherent risks, including the risk of collision, equipment failure, property damage, serious injury, disability, and death. Each rider is responsible for:
  • deciding whether they are capable of participating safely;
  • maintaining a valid motorcycle license or endorsement;
  • maintaining legally required registration and insurance;
  • using a properly maintained, street-legal, and roadworthy motorcycle;
  • wearing legally required and appropriate protective equipment;
  • following traffic laws and lawful instructions;
  • navigating turns, intersections, traffic, and road hazards independently;
  • riding within their own experience and ability;
  • evaluating weather, traffic, road, mechanical, and personal health conditions; and
  • making their own decision about whether to begin, continue, leave, or rejoin a ride.
Information on this website is not a substitute for motorcycle training, professional instruction, mechanical inspection, medical advice, legal advice, or a rider’s own judgment. Nothing on this website represents a promise or guarantee that participation in a motorcycle ride will be free from risk. These website terms are not a ride waiver or release of liability. Participation may require the rider’s separate, affirmative acceptance of the applicable Rider Disclaimer and Liability Waiver.

7. Acceptable Use

You may use the website for lawful, personal, and noncommercial purposes, including learning about SoulFire and contacting us regarding legitimate club-related matters. You agree not to:
  • use the website for an unlawful, fraudulent, threatening, harassing, or abusive purpose;
  • attempt to gain unauthorized access to the website, hosting account, administrative systems, or another person’s information;
  • interfere with the website’s operation or security;
  • introduce viruses, malicious code, automated attacks, or other harmful material;
  • use automated systems to scrape, copy, harvest, or collect information from the website without permission;
  • use the contact form to send spam, advertisements, harassment, or deceptive messages;
  • impersonate SoulFire, a SoulFire member, or another person;
  • misrepresent your relationship with SoulFire;
  • copy or use SoulFire’s name, logo, patch, photographs, or other content in a way that falsely suggests sponsorship, approval, membership, or affiliation; or
  • use information from the website to harass, threaten, identify, track, or endanger another person.
We may restrict or block access to the website when we reasonably believe someone has violated these terms or is threatening the website, SoulFire, its members, or others.

8. SoulFire Content and Intellectual Property

Unless otherwise stated, the website’s original content – including its text, photographs, graphics, logos, artwork, patch images, design elements, and arrangement – is owned by SoulFire, its members, its licensors, or the person who created the material. You may view the website and share links to its public pages for personal, noncommercial purposes. Unless you have prior written permission, you may not:
  • reproduce or republish substantial portions of the website;
  • sell, license, or commercially exploit website content;
  • modify or create derivative versions of SoulFire’s logos, artwork, or patch designs;
  • use SoulFire photographs in advertising or promotional material;

  • use the SoulFire name or visual identity in a manner that creates confusion about affiliation, membership, sponsorship, or endorsement.

9. Photographs and Information About Individuals

The website may contain photographs and information relating to SoulFire members, former members, founders, supporters, or event participants. You may not use website information or photographs to:

  • identify or locate someone for an improper purpose;
  • suggest that an individual endorses a product, service, political position, organization, or cause without permission; or

When you submit a message through our contact form, you represent that:
  • the information you provide is truthful to the best of your knowledge;

  • your message is not unlawful, threatening, fraudulent, or malicious.
You retain ownership of the content of your message. By sending a message, you give SoulFire permission to review it, retain it as reasonably necessary, and share it with appropriate SoulFire members for the limited purpose of responding to or addressing your inquiry. Please do not send confidential, highly sensitive, or legally privileged information through the contact form. Information submitted through the website is also handled according to our Privacy and Website Policy.

11. Google reCAPTCHA

Our contact form uses Google reCAPTCHA to help protect the website from spam, abuse, and automated submissions. Your use of reCAPTCHA is subject to Google’s applicable Privacy Policy and Terms of Service. Additional information about reCAPTCHA appears in our Privacy and Website Policy. You may be unable to submit the contact form if reCAPTCHA or necessary security functions are blocked or unavailable.

12. Third-Party Websites and Services

The website may contain links to services operated by other organizations, including:
  • Meetup;
  • Facebook;
  • Instagram;
  • Google Calendar;
  • Apple Calendar;
  • other calendar providers; and
  • event venues, businesses, maps, or community organizations.
Third-party websites and services are not controlled by SoulFire. They may have their own terms, privacy policies, fees, account requirements, accessibility practices, and security procedures. A link does not necessarily mean that SoulFire:
  • owns or controls the linked service;
  • endorses everything appearing on the linked website;
  • guarantees the accuracy or safety of the linked content;
  • accepts responsibility for the third party’s actions; or
  • has an official partnership with the third party.
You access third-party websites and services at your own discretion and subject to their terms.

13. Calendar Subscriptions

Our public calendar may allow you to add an event or subscribe through Google Calendar, Apple Calendar, iCalendar, or another calendar service. Calendar information is provided as a convenience and may change after you subscribe. Your calendar application may not display an update immediately or correctly. A calendar subscription does not reserve a place at an event, confirm participation, or constitute acceptance of a separate rider waiver. You are responsible for checking the current Meetup or event listing before attending an activity. SoulFire is not responsible for missed, delayed, duplicated, or inaccurate notifications generated by a third-party calendar application.

14. No Professional Advice

Website content is provided for general informational purposes only. Nothing on the website should be treated as:
  • legal advice;
  • medical advice;
  • motorcycle repair or mechanical advice;
  • professional motorcycle instruction;
  • insurance advice; or
  • a guarantee of road or event safety.
You are responsible for obtaining appropriate professional assistance when needed.

15. Website Availability

We may modify, suspend, restrict, or discontinue any part of the website at any time. We do not guarantee that the website will always be:

  • unauthorized access to the website; or

Nothing in these Terms of Use excludes or limits responsibility that cannot lawfully be excluded or limited, including responsibility arising from fraud, willful misconduct, gross negligence, or a violation of a law intended to protect public safety. This section concerns use of the website. Any separate waiver or agreement associated with participation in a ride or event will be interpreted according to its own terms and applicable law.

18. Responsibility for Website Misuse

To the extent permitted by law, you are responsible for losses, claims, or expenses caused by your unlawful use of the website, your intentional violation of these terms, or your infringement of another person’s rights. This provision does not require you to accept responsibility for conduct caused solely by SoulFire or for responsibility that cannot legally be transferred to you.

19. Reporting Problems or Rights Concerns

Please contact us if you believe that:
  • website content infringes your copyright or other legal rights;
  • a photograph or personal detail should be reviewed;
  • someone is misusing SoulFire content;
  • the website contains a significant error; or
  • website activity presents a security concern.
Provide enough information for us to understand and reasonably investigate the concern.

We may update these Terms of Use when the website, club practices, or applicable requirements change. The updated terms will be posted on this page with a revised effective date. If SoulFire does not immediately enforce a provision of these terms, that does not mean SoulFire has waived the right to enforce it later.

These Terms of Use are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent permitted by law, disputes concerning use of the website will be handled by a court with appropriate jurisdiction in Alameda County, California.
